Penalties for DUI in Pennsylvania are broken up into 3 categories based on Blood Alcohol Concentration(BAC).  The first tier, or what is considered “General Impairment” is for BAC between .08 and .099%.  The second tier, “High Impairment”, is a BAC between .10 and .159% and the third or “Highest Impairment” is a BAC of .16% and up.  Please do note that certain circumstances may automatically place you in a higher tier.
